NSW:Police confirm racing fraud investigation
Police are investigating an alleged fraud scandal inside Harness Racing New South Wales
and the fire bombing of a chief steward's car.
Fairfax and News Limited say the Firearms and Organised Crime Squad has confirmed an
investigation was underway after police were contacted about claims that people in the
industry knew which horses would not be swabbed for banned substances during random testing
at mid-week meetings.
Such information could affect betting activity and the outcome of those races.
Police have also confirmed they are investigating the fire-bombing of chief steward
Bill Cable's car in front of his home last week.

CANBERRA, April 15 AAP - Federal independent MP Andrew Wilkie says he cannot remember
ordering military cadets to commemorate Adolf Hitler's rise to power so won't be apologising
for the alleged incident.
But the Tasmanian MP, who helped deliver minority government to Labor, regrets inappropriate
behaviour for which he was disciplined while at Duntroon Military College almost 30 years
ago.
As a senior cadet in 1983, Mr Wilkie allegedly forced his juniors to salute the 50th
anniversary of Hitler's rise to power, News Ltd has reported.
"I honestly cannot remember anything about that specific allegation," the 49-year-old
told reporters in Hobart on Friday.
"But I have never made a secret of the fact that I was one of many cadets involved
in the bastardisation scandal at the Royal Military College Duntroon in 1983."
The MP, who has a deal with the Labor government to introduce gambling reforms, said
he was concerned the story had emerged at a time when he was "standing between the poker
machine industry and the $5 billion problem gamblers lose on the pokies each year".
"I will not be cowed by the pokies industry and will keep working to drive historic
national poker machine reform to improve the lives of the 95,000 Australians with a pokies
gambling problem and the countless people they affect," Mr Wilkie said.
The Department of Defence is in the midst of a scandal after it was revealed last week
that a cadet filmed himself having sex with an 18-year-old fellow student and let his
mates watch it live online.
Mr Wilkie said he applauded the action being taken to stamp out misconduct at the Australian
Defence Force Academy in Canberra.
But he thinks any investigation should be extended to include Duntroon, the army's
officer training school.
Opposition Leader Tony Abbott told reporters in Brisbane he did not believe the Nazi
salute allegation has the potential to bring down Mr Wilkie and thus the Gillard government.
"The short answer is no, but I'll let him explain whatever it was that happened back
in the early `80s when he was a military officer," Mr Abbott said.
"I think it's important to see things in perspective and I just make a plea to all
people on all subjects to keep a sense of proportion about it.
"It's a matter for Mr Wilkie to deal with and I gather he's done his best to do so today."
Prime Minister Julia Gillard refused to enter into the debate except to say Mr Wilkie
was a "very, very young man" at the time.
"Andrew Wilkie is the only person who can tell his life story," she said.
Bastardisation usually involves bullying, humiliation or physical abuse as a way of
initiating a person into a group.
Mr Wilkie on Friday acknowledged the behaviour was wrong and inappropriate but insisted
the bastardisation with which he was involved did not include physical or sexual harassment.

A man is fighting for his life in hospital after he was elbowed in the head as he left
a Melbourne bar.
Victoria Police are calling for witnesses to the attack on the 37-year-old man from
Western Australia as he left a King Street bar just after 6 o'clock this morning.
Police say the offender is described as Caucasian .. in his early 30s with a solid
build and brown hair.

The major political parties might still be fighting over paid parental leave .. but
thousands of employees of Australian corporations are already at home feeding .. changing
and bathing the baby.
A survey by HR consulting firm Hewitt Associates has found 71 per cent of Australian
corporate organisations are already offering some form of paid parental leave.
The survey found most companies recognise the long-term value of offering paid parental
leave to support and retain loyal employees .. as well as attract them back to work after
leave.
But some aren't yet sure how to address the issue and are waiting for the election
outcome before they commit to paid parental leave.

SYDNEY, April 9 AAP - A former boxer's depression and obsessive compulsive disorder
(OCD) can't be used as an excuse for bashing an elderly man, a court has heard.
Grant Eric Brown, 31, of Mornington in Tasmania, punched 70-year-old John Edward Lane
in the face on a Sydney ferry late last year.
Brown, a former professional boxer, appeared in a Sydney's Downing Centre Local Court
on Friday to make submissions about his depression and OCD.
But Magistrate Judith Fleming said there was no link between his mental illness and the crime.
She said there was no indication in the psychological reports submitted to her that
Brown's illnesses caused aggression.
"If anything, the reports talk about withdrawal," Ms Fleming told the court.
Brown broke down and cried as the magistrate handed down her decision not to throw
his case out of court.
He is due to re-appear for sentencing in June after entering a plea of guilty.
The court heard Brown received an upsetting call from his girlfriend at about 6pm on
November 16 last year, shortly after the Manly Ferry left Circular Quay.
Witnesses described his behaviour as aggressive, saying he was kicking walls and bins.
When Mr Lane's friend asked Brown to calm down, he replied: "I'm going to bash your
head in. What the f*** are you looking at? I swear I am going to punch your head in".
The court heard Mr Lane intervened, telling Brown not to talk that way in front of ladies.
Brown then turned on Mr Lane, saying: "Step away. I swear I am going to punch you in
the f***ing head," before hitting him in the face.
Police documents tendered to the court said Mr Lane fell to the deck and witnesses
described hearing "a loud banging noise, similar to the sound of a bursting balloon".
Brown, who once fought on the undercard of an Anthony Mundine bout, pulled Mr Lane
off the ground by his clothing while blood poured from his head.
"The accused suddenly changed his demeanour ... shouting hysterically: `Someone help
him, someone help him'," the police documents say.
Police prosecutor Wayne Horan told the court on Friday that Mr Lane had lost 80 per
cent of his hearing in one ear as a result of the attack.
Both Mr Horan and Ms Fleming said Brown's training as a boxer had to be taken into
account, with the prosecutor saying "he has a responsibility to the community not to use
his ability against innocent civilians".
The defence claimed a specific set of circumstances led to Brown's outburst, including
running out of his medication, and it was unlikely to occur again.
However, Ms Fleming disagreed, saying distressing phone calls and feeling annoyed with
other passengers on public transport were common occurrences that shouldn't end in violence.

SYDNEY, Aug 27 AAP - Three days before a prisoner killed his cellmate, he took pleasure
in telling a psychologist he wanted to bash someone in the head with half a brick, a Sydney
inquest has been told.
Long Bay prison inmate Craig Behr, 24, died of severe head injuries on March 27, 2004
after being beaten by the man he was put into a cell with less than an hour before.
Michael Allan Heatley, a convicted armed robber, pleaded guilty to manslaughter over
Behr's killing and was jailed for that crime in 2006.
In an interview with Heatley on March 24, 2004, forensic psychologist Dannielle Matsuo
said he told her "he wanted to kill someone" and that he "had homicidal urges".
In the report Ms Matsuo subsequently wrote, read to Glebe Coroner's Court on Thursday,
she stated Heatley took pleasure in his urges to kill.
"He took pleasure to describe how he wanted to kill someone and how that urge felt,"
the report stated.
Heatley then remarked: "my little secret's out now".
Ms Matsuo noted her belief that Heatley would not need to be provoked into killing
someone and posed a genuine risk to other inmates.
"My opinion was he could not guarantee me, by his thoughts or verbalisation of those
thoughts, that he would not follow through with those thoughts," she told the inquest.
Immediately after the interview, Ms Matsuo recommended to officers that Heatley be
placed in a one-man cell.
"There was two officers and I verbally informed them that he was not a risk to himself
but a risk to others and (should) be put into a one-out cell," she said.
Deputy State Coroner Malcolm McPherson is examining whether it was reasonable for corrective
services officers to then lock Behr in the same cell as Heatley.
The inquest continues.

Vic: More than $1 million raised for volunteers at race day
More than a million dollars has been raised by the Victorian racing industry for the
state's volunteer firefighters.
The money was gathered at Super Saturday at Flemington Racecourse today.
Victoria Racing Club chief executive DALE MONTEITH says the money would be used to
promote volunteerism and the welfare of volunteers.
Many VRC staff gave up a day's annual leave to the cause.

Qld: Justice review overdue: Opposition
BRISBANE, Aug 9 AAP - The state opposition has described a wide-ranging review of Queensland's
justice system as "long-overdue".
Opposition legal spokesman Mark McArdle said Queensland had the most inefficient court
system in Australia with more than 31,000 criminal and 34,000 civil cases caught up in
the justice gridlock last year.
"This review is long overdue after years of neglect," Mr McArdle said.
Queensland Attorney-General Kerry Shine said the review would examine aspects of the
justice system and identify practical improvements to resolve cases more quickly and fairly.
The review ill be overseen by Martin Moynihan QC, a former senior judge administrator
of the Supreme Court.
Submissions to it can be made until September 5.
"I welcome feedback from our key stakeholders in the legal community and others with
an interest in the justice system and look forward to the outcomes of the review," Mr
Shine said.
Mr McCardle has called on the Queensland government to give a commitment to release
the findings of the review publicly.
"The people of Queensland deserve a guarantee that the review won't be fobbed off to
the Queensland Law Reform Commission," he said.
"The shocking state of our court backlog has blown out under this attorney's watch
and only now is he finally being forced to act."

Fed: Sydney Airport applauds open skies agreement
CANBERRA, Feb 15 AAP - Sydney Airport says the open skies agreement reached between
Australia and the United States is great news.
Under previous restrictive arrangements, new airlines were permitted only four services
a week between the two nations.
Today Transport Minister Anthony Albanese said Australian and US airlines would now
able to determine the frequency of services routes without government interference.
Sydney Airport chief executive officer Russell Balding offered unqualified approval.
"The significant progress it (open skies) represents towards genuine open skies is
a positive development for the travelling public and the aviation industry," Mr Balding
said in a statement.
"With V Australia due to commence flights soon, this announcement provides the potential
for an important boost to the NSW tourism industry."

HERMANNSBURG, NT, Aug 28 AAP - Prime Minister John Howard says Labor's industrial relations
policies "fall short" of what is needed to maintain employment and support small business.
Mr Howard, who is visiting a remote Aboriginal community in central Australia today,
said he was yet to see the details of the measures announced by Opposition Leader Kevin
Rudd and workplace spokeswoman Julia Gillard in Canberra this afternoon.
"(But) I can predict now ... that it will fall a long way short of what is needed,
to maintain the very low levels of unemployment we have at the present time," he told
reporters in Hermmansburg.
"If the reports are to be believed, and I have not seen the detail, then there is no
hope for small business in it because they are going to bring back the unfair dismissal
laws that will produce higher unemployment in the future."
Mr Rudd today outlined the second phase of Labor's IR policy, announcing that Australian
Workplace Agreements (AWAs) would be phased out by the end of 2009.
Labor will also keep strict conditions preventing union bosses barging into workplaces
and remove the award structure for staff on more than $100,000 if it wins government.
The main elements of Labor's new system, including 10 minimum national employment standards,
new simplified awards and the start of Fair Work Australia, will begin on January 1, 2010.

CANBERRA, Dec 13 AAP - Both sides of federal politics will have to show restraint in
their spending promises in the run-up to next year's election to prevent consumers bearing
the brunt of even higher interest rates, private forecaster Access Economics said in a
report on retailing today.
Access expects the fortunes of retail spending can improve from now to mid-2008 if
interest rates rise no further and potentially fall from late 2007.
But if the coalition and Labor succumb to a bidding war, another interest rate rise
would be likely, hurting retail spending, especially along the eastern seaboard, it said.
"Nor would the west escape, as a further rate rise might be enough to see Perth's housing
price gains finally shudder to a halt."
Stable to lower interest rates will boost consumer sentiment and take pressure off
house prices, and provide a lift for housing construction.
Access also expects petrol prices will remain around current lower levels for a year or so.
The forecaster expects real retail turnover will grow by 3.0 per cent in 2006/07, compared
with 2.4 per cent in 2005/06, peaking with the next housing upswing in 2007/08 with growth
of 4.1 per cent.
It then expects growth to moderate again to 3.1 per cent in 2008/09 and 2.1 per cent in 2009/10.
However, Access sees some negatives for retailing outlook, with the growth in the jobs
market easing, the Australian dollar reversing its recent buoyant trend, sharemarkets
stabilising and the drought hurting regional spending.
There has been a tug-of-war between retail positives - tax cuts, strong job gains,
west coast housing prices, share prices and petrol prices - and negatives - interest rates
and Sydney house prices.
"Recent months saw the negatives dominate, with retail sales growth losing some of
the momentum which had built up until early 2006," Access said.
"Interest rates are clearly hurting, amid fears that the Reserve Bank hasn't finished
yet, and that will hurt housing prices."
Yet despite these negatives, Access sees the resumption of the retail recovery arriving
soon, driven by rising real wages and an expected turn in the interest rates cycle.
The Northern Territory and Western Australia are expected to stay on top of the states
league ladder, boosted by the commodities boom, which is lifting population, house prices
and retail spending.
"Queensland is getting its share of the boom too, but its relatively larger and more
diverse economy dilutes the impact of the resource boom," Access said.
The Australian Capital Territory is benefiting from jobs growth and a massive office
building boom, as well as a jump in the supply of retail space.
However, retail growth in Tasmania is showing some signs of easing as jobs growth dries
up, while NSW, Victoria and South Australia are expected to remain in the slow lane.
Access said while the retail difficulties of these last three states were diverse,
in general their house prices went too high and were now struggling amid rate rises.
They are also Australia's manufacturing heartland and are suffering from a strong Australian
dollar and rising interest rates. Additionally, they have the oldest populations in Australia
and their baby boomers are retiring in increasing numbers.

Queensland Premier PETER BEATTIE has briefed the Labor caucus on his plan to solve
the state's water crisis.
Caucus met this morning to formalise the water plan .. which was approved by cabinet yesterday.
Mr BEATTIE's expected to use special emergency powers .. to force councils to meet
deadlines on the completion of new water projects.
He'll announce details of the plan in parliament this morning.
The state's south-east is facing the worst drought on record .. and there's little
hope for significant rain in the next three months.

Queensland parliament was suspended briefly today after the Speaker ejected an Opposition
MP for unruly behaviour.
Speaker TONY MCGRADY suspended parliament for 15 minutes after losing patience with
Nationals MP KEV LINGARD .. who refused orders to leave the chamber.
Mr LINGARD .. himself a former speaker .. was later suspended for 24 hours.
Mr MCGRADY denies he over-reacted by suspending operations .. saying Mr LINGARD had
thrown the house into grave disorder by deliberately refusing his orders three times.

A concerted push to change Victoria's laws so that abortions are no longer illegal
will be made at this weekend's ALP state conference.
The Labor women's policy committee wants the Crimes Act to be amended so that no termination
by a properly qualified doctor .. and at a women's request .. is illegal in Victoria.
The committee's resolution .. obtained by The Age newspaper .. is also urging delegates
to support alternative termination procedures such as the controversial abortion drug
RU486.
The proposed policy also calls for IVF to be equally accessible to all women .. including
gay and single women.
Labor MP CHRISTINE CAMPBELL says she will oppose any plan to make abortion legal.

As an aspiring actress, Nicole duFresne had roles in dozens of way-off-Broadway productions.
But it was an unfortunate real-life line witnesses say duFresne uttered before her slaying _ "What are you going to do, shoot us?" _ that has brought her to the public's attention.
Authorities have refused to speculate whether the 28-year-old actress and playwright's defiant stand against a bandit prompted him to shoot her to death last week on a New York City street.
Safety advocates, however, have cited the case as a lesson in what not to do during a holdup.
On Wednesday, the Washington-based National Crime Prevention Council responded to widespread reports about duFresne's last words by circulating a list of tips on how to survive a mugging.
"It demonstrates that confronting an attacker is probably the worst thing you can do," said council spokesman Todd Post.
DuFresne, a Minnesota transplant whose Internet resume listed "stage combat" as one of her skills, was leaving a bar with her fiance and another couple at about 3 a.m. Jan. 27 when they were accosted by a group of youths who had already tried to rob another person earlier in the evening.
Witnesses told police that when the group demanded the other woman's purse, duFresne responded with: "What are you going to do, shoot us?" Police said she also may have gotten into a brief shoving match with the shooter before he fired a bullet into her chest.
Police arrested the alleged triggerman, Rudy Fleming, 19, and two teenage girls they say took a cell phone and credit cards and helped hide the murder weapon. All three have been charged with murder and robbery.
The fiance, Jeffrey Sparks, said Thursday that he didn't hear duFresne challenge Fleming. But, given her strong personality, he said it "sounds like something she'd say."
Servisio Simmon, 21, a member of the group of youths who was taken into custody but released, gave a different version to The New York Times.
Simmon claimed duFresne told the alleged triggerman: "You got what you want? You got what you want?" He also said the actress "kept raging after Rudy, she kept pushing him, she slipped over the snow" and that the gun "went off."
Police declined to comment on that account.
On its tip sheet, the crime prevention council advises potential victims to stay cool and comply with robbers. At the same time, people should take mental notes on what the assailant looks like so they can provide a detailed description to police, the sheet says.
A robbery "is more about power than anything," said Alfonso Lenhardt, president of the nonprofit council, known for its McGruff the Crime Dog mascot.
"It's a tragedy, but in this case it sounds like (the suspect) felt he wasn't getting the respect he was due," Lenhardt said. "When a gun is in the hands of a desperate person with low self-esteem, they're going to react that way."
The others charged in the killing are Ashley Evans, 18, and Tatianna McDonald, 14. Two young men were charged in the earlier robbery attempt, while two other youths are considered by police to be witnesses.
A graduate of Emerson College in Boston, duFresne was a founding member of the Present Tense Theater Project and acted with the LAByrinth Theater Co., according to her online resume. She wrote a play called "Burning Cage" with Mary Jane Gibson, the woman with her and her fiance at the time of the shooting.
"Burning Cage," about two women in an asylum who are targeted for brainwashing experiments with LSD, toured in 2002 at fringe theater festivals in Canada and the United States.
DuFresne's other play, "Matter," is about an amnesiac whose apartment is taken over by a violent and seductive intruder. It was performed in Brooklyn in 2003.
